Town of Stoneham, Massachusetts.  Sealed bids for Water System Improvements - 2018 Project for the Town of Stoneham, Massachusetts (hereinafter called the Owner), acting by its Town Administrator will be received at the Public Works Department, 16 Pine Street, Stoneham, Massachusetts, until 2:00 p.m., prevailing time, on March 29, 2018.  Shortly thereafter, the bids will be publicly opened and read aloud at the Hearing Room, Town Hall, 35 Central Street, Stoneham, Massachusetts.  Bids submitted after this time will not be accepted.

In general, the work under these Contract Documents will consist of, but is not limited to, removing approximately 750 linear feet of water main; providing all materials, equipment, labor and supervision for the construction of approximately 750 linear feet of new water main; connecting to existing water mains; replacing hydrants along the new water mains; maintaining local vehicular and pedestrian traffic during construction; trench paving; and associated work, complete with all other appurtenances and related work required to complete the project.

It is anticipated that the total value of the contract will be approximately $85,000. This value is provided for information purposes only and by no means should be interpreted to represent a guarantee.  The Owner reserves the right to allocate funds as they see fit.  The Bidder should be aware that the quantities presented in the Bid Form are estimates only and are for the sole purpose of establishing unit bid prices, which shall be used throughout the duration of the contract.  The summation of itemized costs will be the total base bid for this project.  The Owner will award the contract to the lowest responsible and qualified bidder using the total base bid price.  The Owner will reserve the right to terminate the contract in accordance with the termination clause of the General Conditions of the contract.

The Contract Documents, including Specifications and Drawings, may be examined at the Public Works Department, 16 Pine Street, Stoneham, Massachusetts, on and after March 5, 2018, every weekday between the hours of 9 A.M. and 3 P.M.. Payment to obtain printed Contract Documents shall be by check, in the amount of $40.00 (non-refundable) per set, made out to Town of Stoneham.

Each General Bid must be accompanied by bid security in the form of a bid bond, certified check, treasurer's check or cashier's check.  The amount of such bid security shall be five percent (5%) of the value of the bid.

No bid may be withdrawn within sixty (60) days (not including Saturdays, Sundays and legal holidays), after the date of opening thereof.

A Performance Bond, and a Labor and Material Payment Bond, each in an amount equal to 100 percent (100%) of the Contract price will be required of the successful bidder.

Each bidder shall be required to submit a Bidder’s Qualification Statement with supporting data, as well as a tabulation of subcontractors, suppliers, and other individuals and entities required to execute the work.

Bidders shall certify that they do not, and will not, maintain or provide for their employees any facility that is segregated on the basis of race, color, creed, or national origin.

Neither the United States or the Commonwealth of Massachusetts, or any of its departments, agencies, or employees is or will be a party to this Advertisement for Proposals or any resulting contract.

Bidders on this project will be required to comply with all provisions of Executive Order No. 11246 (requirements for Affirmative Action and Equal Employment Opportunity), the Davis-Bacon Act, Massachusetts Wage Rates, Title VI of the Civil Rights Acts of 1964, regulations promulgated under the Occupational Safety and Health Act of 1970, and other applicable laws.

Attention of bidders is particularly called to the requirements as to conditions of employment to be observed, minimum wage rates to be paid under the contract and affirmative action to ensure equal employment opportunity.

The successful bidder shall be required to submit documentation that all employees to be employed in the work subject to this bid have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration.  Any employee found on a worksite subject to this section without documentation of successful completion of a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration shall be subject to immediate removal.

The right is reserved to waive any informalities in or to reject any or all bids received and to award the Contract to any of the contractors bidding on the work if, in the Town's opinion, the best interests of the Town will be promoted thereby.  The Town of Stoneham is an equal opportunity employer.

Applicable provisions of Massachusetts General Laws and Regulations and/or the United States Code and Code of Federal Regulations govern this Contract and any provision violation of the foregoing shall be deemed null, void and of no effect.
