Stoneham Board of Selectmen – Minutes of Meeting of June 29, 2010

Chairman R. Paul Rotondi called the meeting to order at 7:05 p.m.  Also present were Selectmen John F. DePinto, Richard S. Gregorio, Robert W. Sweeney, Frank Vallarelli, Town Administrator David Ragucci, and Town Counsel William H. Solomon.

Pledge of Allegiance

Approve Minutes

Selectman Gregorio moved approval of the 6/15/10 minutes.  Motion was seconded and unanimously voted.  Selectman DePinto moved approval of the 6/15/10 executive session minutes and not to publish, seconded by Selectman Sweeney.  Motion was unanimously voted.  Selectman Gregorio moved approval of the 6/3/10 minutes, seconded by Selectman Sweeney.  Motion was unanimously voted.

Accept Donation/KnowOurTown.com

Randy Perillo described the gift, consisting of two video message boards and two computers, along with a check for $387 for three years' electric usage, that KnowOurTown.com was presenting to the Town of Stoneham.  Selectman DePinto moved to accept the gift, seconded by Selectman Vallarelli.  Town Counsel clarified that the decision of what would be on there would be the decision of the Town.  

RCN License Transfer of Control/Public Hearing

Town Counsel Solomon said they are here for the transfer and the proposed transfer of control.  He said at the 7/27 meeting they will vote on the transfer.  Thomas K. Steele, V.P. and Regulatory Counsel of RCN, Richard Wadman, Senior V.P. and General manager of RCN, and Todd Wells, a long-time franchising consultant and outside legal counsel for ABRY Partners, were present.  Mr. Steele said he looks forward to the extension for another five years.  He said they did file the form and paid the application fee.  He said he is proud of the fact that they partnered with the Town for the Institutional Network.   Atty. Wells said he anticipates the closing to occur in August.  He said if the Selectmen approve it, the only change will be it will be know as RCN BeCoCom LLC.  Town Counsel Solomon asked, for the record, that they indicate what form of financing will be used by ABRY to purchase RCN.  Mr. Wells said the total purchase price for RCN is just under $1.4 billion.  He said the publicly held shares will be paid off.  He said ABRY is putting $563 million into the transaction and retiring $600 million of debt.  

Approve New Common Victualler License/Town of Stoneham d/b/a Unicorn Golf Clubhouse/460 William St

Selectman DePinto moved approval of the New Common Victualler License for Town of Stoneham d/b/a Unicorn Golf Clubhouse/460 William Street, seconded by Selectman Sweeney.  Motion was unanimously voted.

Liquor Licensing Authority

Selectman DePinto moved to go into Liquor Licensing Authority and return to Board of Selectmen, seconded by Selectman Gregorio.  A roll call vote was taken.

Appoint Members to Committees

Selectman Vallarelli moved to appoint Maureen Buckley to the Memorial Day Parade Committee, seconded by Selectman DePinto.  Motion was unanimously voted.  Selectman Vallarelli moved to appoint Andrea Robin to the Cultural Council, seconded by Selectman DePinto.  Motion was unanimously voted.

Approve Site Plan Extension Letter/95 Maple Street

Selectman DePinto moved approval of the 96 Maple Street site plan extension letter, seconded by Selectman Sweeney.  A roll call vote was taken.

Keno/Continued

Selectman DePinto moved to extend this to the 7/27/10 meeting, seconded by Selectman Gregorio.  Motion was unanimously voted.

Miscellaneous Correspondence

Selectman Sweeney said that, after listening to the people here during the golf course discussion, he thinks they should look at a different usage for Stoneham Oaks.  He said it gets very little play but it gets 40% of the maintenance budget.  Selectman DePinto volunteered to serve on a committee.  Selectman Gregorio said if it is at night, he can serve.  Town Administrator Ragucci suggested asking a Planning Board member, also.  Selectman Gregorio noted the letter from a resident of Greenview Road.  He asked if DPW was going to look at it.  Mr. Ragucci said yes.  Chairman Rotondi noted the letter on what they can do with the rebate for the Special Election.  He said that can decrease the $800,000 by $8,000.

Town Administrator Reports

Mr. Ragucci said the new owner of the old Eastman property, Alan Melkonian, is looking to lease a portion of the bikepath.  He said the MBTA has approved it.  He said they sold Emerald Court for $166,000.  He recommended using it for Capital Committee requests.  He said a bathroom needs to be placed in the teen center.  Mr. Ragucci said they had a Financial Summit meeting last night.  He said they won't make $800,000 in free cash.  He said they should be anticipating a problem with the FY11 budget t the tune of $800,000.  Selectman Gregorio said he updated 2012 to $2.3 million from $1.5 million.  Chairman Rotondi said it is a double whammy because it affects 11 and 12.  

Executive Session

Selectman Sweeney moved to go into executive session, pursuant to Chapter 39, section 23B, for the purpose of discussing Stockwell and contracts, seconded by Selectman DePinto.  A roll call vote was taken.
