Stoneham Board of Selectmen – Minutes of Meeting of August 28, 2007
Chairman George E. Seibold called the meeting to order at 7:00 p.m. Also present were Selectmen John F. DePinto, R. Paul Rotondi, Frank A. Vallarelli, Town Administrator David Ragucci, and Town Counsel William H. Solomon. Selectman Robert W. Sweeney was unable to be present.
Pledge of Allegiance
Liquor Licensing Authority
Selectman DePinto moved to go into Liquor Licensing Authority and return as the Board of Selectmen, seconded by Selectman Rotondi. Motion was unanimously voted (4-0).
Meeting recessed at 7:03 p.m. to go into Liquor Licensing Authority.

MWRA Bonds/Town Treasurer
Town Treasurer Cicatelli said this is an $183,600 grant and a $224,400 0% loan until 2012. Selectman Rotondi moved that the sale of the $224,400 Sewer Bond of the Town dated August 30, 2007, to Massachusetts water Resource Authority (the “Authority”) is hereby confirmed and that the Town Administrator or other appropriate town official is authorized to execute a Loan Agreement and a Financial Assistance Agreement with the Authority with respect to the bond. The bond shall be payable without interest on August 15 of the years and in the principal amounts as follows:

Legislators
Senator Tisei and Representatives Paul Casey and Patrick Natale were present. Senator Tisei said that the pothole grant was recently announced. He said that, in the past, Stoneham didn’t meet any of the criteria. He said Stoneham doesn’t get PILOT because it is MDC land. He said they added a new category for Stoneham so they could qualify under the pothole grant. He said $150,000 went to Stoneham. He said that, in addition to that, the Town Administrator and Superintendent worked on another category for the

Vocational School, and Stoneham qualified under that for $143,000, for a total of $233,000. The Board thanked the legislators.

Appoint Mystic Valley Elder Services Member
Selectman DePinto moved to reappoint Jane Lavender to the Mystic Valley Elder Services Board of Directors, seconded by Selectman Rotondi. Motion was unanimously voted (4-0).

Selectman DePinto moved approval of the 8/16/07 minutes, seconded by Selectman Vallarelli. Motion was unanimously voted (4-0). Frank Petrillo/409-413 Main St/Site Plan Hearing
Selectman DePinto said there are only four members here. Atty. Houghton said they will go forward. Town Counsel Solomon said that Selectman DePinto indicated that the applicant does his lawn and garden service at his home. He said he can publicly announce the relationship and it rebuts anyone’s claim of favoritism, so that Selectman DePinto can participate and is protected under Ethics Law.
Selectman Rotondi read the duly published Notice of Hearing. Atty. Houghton was present to represent Frank Petrillo in his petition to demolish the existing building and build a four-story retail/office condominium building on the property located at 409-413 Main Street, Stoneham, MA, on land owned by Harold G. Paicopolos, Jr. and Deborah Paicopolos, Trustees of 409-413 Main Street Realty Trust, 21 Crystal Drive, Stoneham, MA 02180.
Atty. Houghton sad they need the municipal parking lot to construct this. He said they will resurface the parking lot when done. He said there will be a couple of weeks of demolition in the fall and some months in the spring. He said they will do it with a written agreement. He said that would be a condition of this approval. Selectman Vallarelli read the department recommendations – DPW, Police Department, Board of Health, Fire Chief, and Inspectional Services. It was noted that there is a Board of Appeals Decision and a Planning Board Special Permit.
Chairman Seibold opened the hearing to the public. Dennis Gain, 426 Main Street, Unit 501, said that he has a concern about parking. Chairman Seibold told him that they meet the requirements for parking. Selectman DePinto moved to approve the site plan, subject to the Board of Appeals and the agreement for the use of the municipal parking lot. Town Counsel Solomon said he will submit that in two weeks. Two years is allowed for completion. Atty. Houghton said the hours of construction are 7:00 to 6:00. Motion was seconded by Selectman Rotondi, and a roll call vote was taken.

Set Date of October Special Town Meeting and Open Warrant
Selectman Vallarelli moved to hold the October Special Town Meeting on 10/18/07 at 7:00 p.m. and to open the warrant on 8/28/07 and close it on 9/19/07 at 4:00 p.m. Motion was seconded by Selectman DePinto, and a roll call vote was taken.

Sign Preservation Agreement/Stoneham Fire Station/25 Central St
Selectman Rotondi moved that the Board sign the Preservation Agreement for the Fire Station, seconded by Selectman DePinto. Motion was unanimously voted (4-0).
Approve Block Party/Arnold Rd
Selectman DePinto moved acceptance of the block party to be held on Arnold Road n 9/22 from noon to 9:00 p.m., with a rain date 0f 9/23. Motion was seconded by Selectman Rotondi, and a roll call vote was taken.

Town Day/Request for Town Common and Street Closures/Chamber of Commerce
Selectman DePinto moved to grant the request for the Town Common street closings for Town Day, as requested by Sharon Iovanni, Executive Director of the Chamber of Commerce, in her 8/1/07 letter. Motion was seconded. Selectman DePinto clarified tat this is for Town Day and nothing to do with the Road Race. Motion was unanimously voted (4-0).
Accept Donations
Selectman DePinto moved to accept donations from Karen and John Geraghty and also from the Stoneham Plan Coalition. Selectman Rotondi said this was the coalition to

support the override and this is the balance of donations to close out the committee. Motion was seconded and unanimously voted (4-0).
Boys & Girls Club/Request for Walk
Selectman DePinto moved to grant the request for a Walk for the Boys & Girls Club on 10/13/07, rain date 10/20/07, and instruct them to get together with Officer Rotondi. Motion was seconded by Selectman Vallarelli, and a roll call vote was taken.

Miscellaneous Correspondence
Selectman Rotondi requested to put an item on the 9/11/07 agenda concerning the rink and the possibility they could put it up for sale to a private person who runs rinks.
Selectman DePinto moved approval of the request from Blake Allison to place a plaque in memory of his late wife, Anna Allison, who was killed in the 9/11 attacks. Motion was seconded and unanimously voted.
Town Administrator Reports
Town Administrator Ragucci said he interviewed 5 semi-finalists for Chief of Police. He said the two finalists are Lt. James Pierce from Winchester and Capt. Richard Bongiorno from Cambridge. He said he feels either one is capable of performing the job as Police Chief of Stoneham. He said he hopes to present his decision on 9/11.
He said there will e a vehicle auction on Town Day.
He said the one-hour signs would need approval from the State to change and most likely will have to stay but they will be enforcing a two-hour parking limit.
Town Administrator Ragucci said Stoneham Youth Hockey Concession will not be renewing their contract and they will be done by 10/1/07. He said hopefully he will have a report by 9/11 as to the best choice for the concession stand.
He said the architect is drawing up bid specs for the roof at the Stoneham Arena. He said they spent $1,800 for repairs on the Town Hall roof.
He said they are leasing one bay and he will enter into a lease for 8,000 s.f. on Stevens Street with Gerald McCarthy. He said it will be $1,500 a month payments for land and garage. He said he would like to go to Town Meeting for a longer lease. Selectman Rotondi said they don’t want to be prevented from doing something else. Town Administrator Ragucci said he asked the Alternative Energy Committee to look at Spring Street. He mentioned turning that 3 ½ acres into a solar array.

Selectman DePinto said they should send a formal letter to Mass Highway about the signs for 4-6 and 7-9. He said the State wants them to keep it open so cars can cut through Stoneham. He said it has nothing to do with Stoneham’s people. Selectman DePinto moved to forward a letter to Mass Highway, seconded by Selectman Rotondi. Town Administrator Ragucci said he will do it.
Selectman Rotondi suggested keeping Stevens Street open Sunday or later on Saturday night.
Executive Session
Selectman DePinto moved to go into executive session for contract negotiations and litigation and not to return as the Board of Selectmen. Motion was seconded, and a roll call vote was taken.
