Board of Selectmen Minutes 06/12/2007
Stoneham Board of Selectmen – Minutes of Meeting of June 12, 2007

Chairman George E. Seibold called the meeting to order at 7:00 p.m.  Also present were Selectmen John F. DePinto, R. Paul Rotondi, Robert W. Sweeney, Frank A. Vallarelli, Town Administrator David Ragucci, and Town Counsel William H. Solomon.

Pledge of Allegiance

Approve Minutes

It was moved and seconded to approve the 5/29/07 minutes.  Motion was unanimously voted.  It was moved and seconded to approve the 5/15/07 minutes.  Voting was 4-0-1, with Chairman Seibold abstaining.  Motion carried.  It was moved and seconded to approve the 5/29/07 executive session minutes.  Motion was unanimously voted.  It was moved and seconded to approve the 5/15/07 minutes.  Voting was 4-0-1, with Chairman Seibold abstaining.  Motion carried.  It was moved and seconded to approve the 4/24/07 minutes.  Motion was unanimously voted.

Maintenance of Town Grounds

This item was continued to the 6/26/07 meeting.

Cable Television Stoneham Access Payment

Town Counsel Solomon updated the Board on the status regarding the completion of the process forwarding PEG Access Capital payment to Stoneham Community Access and the Stoneham Public Schools.  Atty. Charles Houghton, President of Stoneham Cable Access Corporation, and Amy Brough, Director of Stoneham Cable Access Corporation, spoke on the hearing at the State House and of the presentation there by Town Counsel Solomon.

Approve Site Plan Decision Letter/250-256 Main St

Town Counsel Solomon asked to continue this to 6/26.  Selectman DePinto moved to table, seconded by Selectman Sweeney.  Motion was unanimously voted.

Addendum:  Approve Block Parties

Selectman DePinto moved to take up the addendum, seconded by Selectman Sweeney.  Motion was unanimously voted.  Selectman DePinto moved approval of the Keene Street Block Party on 6/24, contingent on bringing the application in with the signatures, and Police and Fire approval.  Motion was seconded by Selectman Sweeney, and a roll call vote was taken.

Selectman DePinto moved approval of the Block Party on Waterhouse Road on 6/23, contingent on the application with signatures being brought in and Police and Fire approval.  Motion was seconded by Selectman Sweeney, and a roll call vote was taken.

Miscellaneous Correspondence

Selectman Rotondi asked who will give MAPC the information they are requesting.  Town Administrator Ragucci said he spoke with someone from the Housing Authority about it.

Chairman Seibold reminded everyone about the override vote next         Tuesday.  He said he hopes everyone goes to the polls and takes into consideration all of the planning.  He said the Town definitely needs the money.  Selectman Rotondi said he is personally for the override.  He said it is for everybody.  

Dunkin Donuts/128 Franklin St

Selectman Rotondi recused himself and left the room.  

Atty. Houghton distributed revised site plans for Dunkin Donuts on 128 Franklin Street, that are now up to date.  He said the entranceway on Franklin Street is moved a couple of feet to the east, closer to the condo entrance.  He said the crosswalk is now located on the plan and the utilities are coming in from the rear.  He said the architectural design is now more colonial.  It can be gray with white trim or white with gray trim.  Selectman Sweeney asked if Town Counsel can contact the neighbors to see if they have any preference.  Town Counsel said he can call them and report back directly to the developers.  Selectman Sweeney said he would go along with whatever the neighbors choose.  He said there is no need to come back to the Board.  Atty. Houghton also gave the Board a landscaping plan.  Chairman Seibold opened it to the public.  No one spoke.  Selectman Sweeney moved to approve the alterations, seconded by Selectman DePinto.  A roll call vote was taken.

Motion was unanimously voted (4-0).

Appointments to Committees/Continued

Selectman DePinto moved to appoint Mark Bell and Ellen McBride to the Conservation Commission as Associate Members, seconded by Selectman Sweeney.

Selectman Rotondi returned to the meeting at 7:49 p.m.

A roll call vote was taken.

Selectman DePinto moved to appoint Jack Bracciotti to the Water/Sewer Review Board, as the Finance Board designee.  Motion was seconded by Selectman Sweeney, and a roll call vote was taken.

Town Administrator Reports

Town Administrator Ragucci said they will be changing the health care provider to Tufts, effective 7/1.

Mr. Ragucci said he would like the Board to note and he sends his personal thanks to Jan Houghton for the donation for a sign in Stoneham Square informing citizens of the 6/19 override election.

Mr. Ragucci said they are hiring a Time/Construction Clerk, and he asked the Board to waive the 7-day requirement.  Selectman Sweeney moved to grant this waiver, seconded by Selectman Rotondi.  A roll call vote was taken.

Motion was unanimously voted (5-0).

Mr. Ragucci said he met with John Flynn from Fiesta Shows, on the suggestion of Selectman Sweeney, to bring a carnival into town at Redstone.  He said it will be 7/18 to 7/22.  He asked the Board to amend some items on the 1993 fee schedule.  The permitting fee will go from $50 to $100 for Board of Selectmen approval and the third paragraph will be amended from 1:00 p.m. to 12:00 p.m. on Sunday.  He said Mr. Flynn is willing to guarantee the Town $5,000 or 20% of ticket sales.  Mr. Ragucci suggested using it for Memorial Day exercises.  Selectman Sweeney moved to increase the Board of

Selectmen permit fee from $50 to $100 and change the starting time from 1:00 p.m. to 12:00 p.m.  Motion was seconded by Selectman DePinto, and a roll call vote was taken.

Motion was unanimously voted (5-0).

Executive Session

Selectman DePinto moved to go into executive session, pursuant to Chapter 39, section 23B, to discuss litigation strategy and Stockwell Trust.  Motion was seconded.  

Selectman Sweeney asked about the Police Chief search and if the applications needed to be reopened.  Chairman Seibold said he would like to keep it open another week or two.  Town Counsel said they could advertise on cable and the website and, if legally required, in the newspapers.  Selectman Sweeney moved to reopen the Police Chief search for two weeks.  Motion was seconded and unanimously voted.

A roll call vote was taken on the executive session motion.
