Stoneham Board of Selectmen – Minutes of Meeting of May 15, 2007

Vice Chairman John F. DePinto called the meeting to order at 7:18 p.m.  Also present were Selectmen R. Paul Rotondi, Frank A. Vallarelli, Town Administrator David Ragucci, and Town Counsel William H. Solomon.  Selectman Robert W. Sweeney arrived at 7:32 p.m.  Chairman George E. Seibold was unable to be present.

Pledge of Allegiance

Historical Commission/Heritage Award

Steve Rotondi, Chairman of the Historical Commission, announced that Paulene “Bee” Russo is this year’s recipient of the Heritage Award.  He then presented Bee Russo with the award.

MWA Grant Loan/Town Treasurer

Tom Cicatelli, Town Treasurer, was present.  He said this is a combined grant and zero percent loan from the MWRA.  Selectman Rotondi moved that the sale of the $1,360,800 Water Bond of the Town dated May 24, 2007, to Massachusetts Water Resource Authority (the “Authority”) is hereby confirmed and that the Treasurer or other appropriate town official is authorized to execute a Loan Agreement and a Financial Assistance agreement with the Authority with respect to the bond.  The bond shall be payable without interest on May 15 of the years and in the principal amounts as follows:

Motion was seconded by Selectman Vallarelli, and a roll call vote was taken.

Motion was unanimously voted (3-0).

Bonds/Town Treasurer

Tom Cicatelli, Town Treasurer, was present.  Selectman Vallarelli moved that the sale of the $2,299,000 Municipal Purpose Loan of 2007 Bonds of the Town dated May 15, 2007, to Stifel Nicolaus & Company, Incorporated at the price of $2,339,119.15 and accrued interest is hereby confirmed.  The bonds shall be payable on May 15 of the years and in the principal amounts or mandatory redemption payment amounts and bear interest at the respective rates, as follows, subject to earlier redemption at the option of the Town as provided in the Preliminary Official Statement dated April 26, 2007:

Motion was seconded by Selectman Rotondi, and a roll call vote was taken.

Selectman Sweeney arrived at 7:32 p.m.

Liquor Licensing Authority

Selectman Sweeney moved to go into Liquor Licensing Authority and return as the Board of Selectmen, seconded by Selectman Vallarelli.  A roll call vote was taken.

Meeting recessed at 7:33 p.m. to go into Liquor Licensing Authority.
Meeting reconvened at 7:37 p.m.

Robert Sansone/Request to Designate Rte 28 as “Equality Road”

Bob Sansone, 22 Wilson Road, discussed his bill to designate Route 28 in Stoneham as “Equality Road”.  His daughter Rachel was also present.  Selectman Sweeney moved to table this until they have a full board.  Motion was seconded and unanimously voted voted.

Exxon Mobil Corp/250-256 Main St/Site Plan Hearing

Selectman Vallarelli read the Notice of Hearing.  Atty. Michael Peirce was present to represent Exxon Mobil Corp. in its petition to remove the existing sales/transaction kiosk and shed, replace the canopy and construct a 2100 s.f. retail convenience store on the property located at 250-256 Main Street, Stoneham, MA on land owned by Mobil Oil

Corp., c/o Exxon Mobil Oil Corp., PO Box 4973, Houston, TX 77210-4973 and Exxon Mobil Oil Corp., Property Tax Division, CORP-EMB-2305A, Houston, TX 77001-0053.

Mike Loin, Burton Engineer, said they are going to the ZBA for a complete signage package.  Selectman Sweeney suggested clapboard or brick to make it more New England style.  Mike Loin and Tyler Paytas, Project Manager for Exxon Mobil, said they were actually considering clapboard.  Mr. Loin said it is a composite that looks like clapboard and they could bring a rendering to the next meeting.  He said the color scheme is grey with a white trim.  Selectman Sweeney asked if this means they won’t be leasing the space out.  Atty. Peirce said they will find they have a more coordinated retail package.  Mr. Paytas said the dealer does not have that much leeway.  Selectman Sweeney asked if it is possible to put some windows on the Main Street side, even if they are fake.  Atty. Peirce said it is possible to consider it.  Selectman DePinto said he would like an answer from Town Counsel for 5/29, regarding hours of operation.  Town Counsel Solomon said he will work with the counsel and applicant.  Selectman Vallarelli asked Town Counsel why they didn’t need a Special Permit from the Planning Board.  Town Counsel said it is as if it’s an amendment to the previous approval and that is why they were directed to site plan.  Selectman Vallarelli said it is not really the same lot.  Town Counsel said he will work with the Building Inspector to address this issue, if he would like another more formal opinion from the Building Inspector.  Selectman Vallarelli said no.  

Vice Chairman DePinto opened the hearing to the public.

Scott Levine asked if it is possible to prohibit tobacco signage, since it is so close to a school.  Atty. Peirce said they would like to be able to be competitive with any similar business in the general area.  He said he would get back to them, and that they are sensitive to their location.  Mr. Paytas said they would also like to talk to the dealer.

Selectman Sweeney moved to continue to 5/29/07 at 7:30 p.m.  Motion was seconded by Selectman Rotondi, and a roll call vote was taken.

Motion was seconded by Selectman Rotondi and unanimously voted (4-0).

Appointment to MBTA Advisory Board

Selectman Rotondi moved to appoint Frank Vallarelli as the representative to the MBTA Advisory Board, pending approval of Town Counsel.  Motion was seconded by Selectman Sweeney and unanimously voted.

MAPC Election

Selectman Sweeney moved to vote for Dennis Giombetti of Framingham, seconded by Selectman Vallarelli.  Motion was unanimously voted.  Selectman Sweeney moved to vote for Joseph Curtatone of Somerville, seconded by Selectman Rotondi.  Motion was unanimously voted.

Sign Warrant

The Board of Selectmen signed the Special Election Warrant.

Annual Appointments/Continued

Selectman Rotondi moved to appoint Kathleen Danieli to the Water/Sewer Review Board, seconded by Selectman Vallarelli.  Voting was 3-1, with Selectman Sweeney opposed.  Motion carried.

Miscellaneous Correspondence

Selectman Vallarelli said the residents of South Street have an attorney.  He said they asked Town Counsel if the Town would be willing to accept the roadway.  He said he doesn’t think they are right now.  He said the abutters don’t want to purchase the land out front. They want to get back to the status quo to pass and repass.  He said there is nothing for the Board to do at this point until DCR makes a decision.  Selectman Rotondi suggested a letter to the neighbors.  Town Counsel suggested a letter that the Town supports the residents’ efforts to guarantee their right of access to this road and to have the DCR cooperate and the Town hopes the DEC will cooperate.  Selectman Rotondi suggested Town Counsel draft this letter and have David Ragucci sign it.  The Board agreed.

Selectman DePinto noted the letter from Verizon that wanted the Town to back a bill changing the licensing of Cable TV.  He said that Town Counsel, Amy Palmerino, and he went to the state House and met in the Speaker’s office.  He said the Town could lose hundreds of thousands of dollars and could lose their public access station.  He said he can’t believe Verizon had the gall to send this letter to the Town to support this.  Town Counsel suggested that they have the Chairman sign a letter to the representatives and senator and the chair of the committee.  He said it would be helpful to have any Board members testify on 6/5.

Selectman Sweeney noted the letter from Mr. Marchese on Campbell Road about a tree lifting up his sidewalk.  He asked the Board to direct the Town Administrator to contact Bob Grover to see if they can take care of it.  

Selectman Sweeney noted the condition of the Common and Town Hall lawn with weeds.

Executive Session

Selectman Rotondi moved to go into executive session, pursuant to Chapter 39, section 23B, for the purpose of discussing litigation, collective bargaining, and Stockwell Trust.  Motion was seconded, and a roll call vote was taken.
