Stoneham Board of Selectmen – Minutes of Meeting of December 12, 2006
Chairman Robert W. Sweeney called the meeting to order at 7:04 p.m. Also present were Selectmen John F. DePinto, Anthony C. Kennedy, R. Paul Rotondi, George E. Seibold, Town Administrator Ronald J. Florino, and Town Counsel William H. Solomon.

Approve Minutes
Selectman Seibold moved approval of the 11/21/06 minutes, seconded by Selectman DePinto. Voting was 4-0-1, with Chairman Sweeney abstaining. Motion carried. Selectman DePinto moved approval of the 11/14/06 minutes, seconded by Selectman Seibold. Motion was unanimously voted. Selectman Seibold moved approval of the 11/21/06 executive session minutes and not to release, seconded by Selectman DePinto. Motion was unanimously voted. Selectman DePinto moved approval of the 11/14/06 executive session minutes and not to post, seconded by Selectman Seibold. Motion was unanimously voted.
Approve Site Plan Approval Letter/85 Maple Street
Selectman Rotondi moved approval of the site plan approval letter for 85 Maple Street, seconded by Selectman DePinto. A roll call vote was taken.

Approve Site Plan Approval Letter/237-241 Main Street
Selectman DePinto moved approval of the site plan approval letter for 237-241 Main Street, seconded by Selectman Rotondi. A roll call vote was taken.

Liquor Licensing Authority
Selectman Rotondi moved to go into Liquor Licensing Authority and return as the Board of Selectmen, seconded by Selectman Kennedy. A roll call vote was taken.

Approve Class I License Renewals
Selectman Seibold moved approval of the following Class I License renewals: Stoneham Motor Co., Inc./185 Main St. and Danvers N II, Inc. d/b/a Ira Nissan of Woburn/95 Cedar St. Motion was seconded by Selectman DePinto and unanimously voted.
Approve Class II License Renewals
Selectman Rotondi moved approval of the following Class II License renewals: Act Leasing, Inc/51 Montvale Ave; COV Motors, Inc./28 Pine St; Edward A. Fedele and Francis X Fedele d/b/a Fedele Auto Sales/263 Main St; Franklin Street Truck & Auto, Inc/41 Franklin St; Michele Mazzola d/b/a M & S Motors/18A Gould St; and Ronald W. Penkethman d/b/a Pine Street Motors/45 Pine St. Motion was seconded by Selectman DePinto and unanimously voted. Selectman DePinto moved approval of the Class II License renewal for Justin A. Rotondi and John Nicholls d/b/a Rotondi Motors/140 Franklin St, seconded by Selectman Kennedy. Voting was 4-0-1, with Selectman Rotondi abstaining. Motion carried.
Approve Entertainment License Renewals
Selectman DePinto moved approval of the Weekday and Sunday Entertainment Licenses for Montvale Plaza and the Weekday Entertainment License for SATO II Restaurant, seconded by Selectman Rotondi. Motion was unanimously voted.
Addendum: Approve New Common Victualler License/Pizza Mia Stoneham, Inc. d/b/a Pizza Mia/67 Franklin St
Selectman DePinto moved to take up the addendum, seconded by Selectman Rotondi. A roll call vote was taken.

Selectman DePinto moved approval of the New Common Victualler License for Pizza Mia Stoneham, Inc. d/b/a Pizza Mia at 67 Franklin Street. Motion was seconded by Selectman Seibold and unanimously voted.
Miscellaneous Correspondence
Selectman Seibold said that the bikepath hasn’t been built yet. He said things were done in the past that are costing the Town money without bringing revenue back. He said he called Arlington about their bikepath. There was one initial cost but it cost the Town a lot of money after, because they had a policeman on bicycle. That had a slow response time so they put an officer on a motorcycle. Selectman Seibold said Stoneham can’t even afford the Police that they have. He said maybe they should give some serious thought regarding crime, such as breaking and entering and sexual predators. He said that in Arlington someone strung up fishing line. He asked who will maintain and clean it. Selectman Seibold said there will be a lot of cost for this and that at night it
will be a place

for kids to hang out. He said that instead of it being a guzzler for the Town they should look at how it can raise money for the Town. He said people will want lights there. Chairman Sweeney said he thinks the Town could raise $15,000 to $20,000 per month from the abutters. He asked Town Counsel about restrictions. Town Counsel said they could discuss it in executive session. Selectman Seibold added that people could sue the Town if anything happened. He said there are more negatives on the bikepath than positives, especially with Stoneham being a cut-through town. Selectman Kennedy said a lot of research is needed to see if they can reverse what has taken place. Selectman Rotondi said he thinks Selectman Kennedy’s point is valid. He said they have to look
to see what they can do. Selectman Seibold said he doesn’t see this as a political thing, he sees it as a safety issue. Selectman DePinto agreed.
Selectman DePinto asked about the Green Street property owned by Wakefield. Chairman Sweeney noted the letter from DPW Director Grover suggesting a land swap with Wakefield. Town Administrator Florino will call the Wakefield Town Administrator. Selectman Seibold said it was on Wakefield’s agenda this Monday. Selectmen DePinto and Seibold will meet with them.
Selectman Kennedy asked Town Administrator Florino to see if Stoneham is on the TIP list.
Town Administrator Reports
Town Administrator Florino said he would like the approval of the Board to hire the Senior Engineer. Chairman Sweeney asked if the residents would have a lower water/sewer rate if DPW was not funded by Water/Sewer. He said taxpayers are funding it. Selectman Rotondi asked what the average water bill is. He said they should be able to say how much is MWRA and how much is the town. Mr. Florino said 80% is probably the MWRA. Chairman Sweeney and Selectman DePinto said they have no problem with moving forward with that.
Selectman Kennedy reported on the DCR public meeting concerning the hospital site, that he attended. He said Mr. Gutierrez is footing the bill for the meetings.
Executive Session
Selectman DePinto moved to go into executive session, pursuant to Chapter 39, section 23B, for the purpose of discussing Stockwell Trust, litigation, and legal issues, and not to return as the Board of Selectmen. Motion was seconded by Selectman Kennedy, and a roll call vote was taken.
