Stoneham Board of Selectmen – Minutes of Meeting of November 21, 2006

Vice Chairman John F. DePinto called the meeting to order at 7:10 p.m.  Also present were Selectmen Anthony C. Kennedy, R. Paul Rotondi, George E. Seibold, Town Administrator Ronald J. Florino, and Town Counsel William H. Solomon.  Chairman Robert W. Sweeney was unable to be present.

Pledge of Allegiance

Whip Hill Trust/Annual Donation and Additional Donation/Dan Towse

Dan Towse, Administrator of Whip Hill Trust, presented the Board with a check in the amount of $10,950 and a check in the amount of $5,000.  He said the $5,000 will go to the fund for maintenance.  

Tax Rate/Public Hearing

Frank Golden, Director of Assessing, and Chairman William Jordan and Member Richard Mangerian of the Board of Assessors were present.  Mr. Golden gave a presentation and the Board of Assessors’ recommendation on the shift.  Vice Chairman DePinto opened the hearing to the public.  Sharon Iovanni, 16 Girard Road, asked them to hold off on the shift this year.  James Juliano, Ellen Road, said he hopes the Board would adopt the recommendation of the Board of Assessors regarding the shift.  Selectman Seibold moved to accept the Board of Assessors recommendation for a 1.63 shift, seconded by Selectman Kennedy, so that it will be a $10.53 residential rate that starts with a factor of $10.53 and with the shift will be $9.74.  A roll call vote was taken.

Voting was 3-1.  Motion carried.

Mr. Mangerian said the Board of Assessors recommended not toaccept the Open Space Exemption.  Selectman Seibold moved to not accept the selection of a discount for Open Space, seconded by Selectman Kennedy.  Motion was unanimously voted (4-0).

Mr. Mangerian said the Board of Assessors recommended not to accept the Residential and/or Small Commercial Exemptions.  Selectman Kennedy moved not to accept Residential and/or Small Commercial Exemptions, seconded by Selectman Rotondi.  Motion was unanimously voted (4-0).
                                                        
85 Maple St/Site Plan Hearing/Extension

Selectman Seibold read the Notice of Hearing.  Atty. Charles Houghton was present to represent Advanced Dental Technologies, Inc. in their petition for a 1-year extension of the site plan approval of December 21, 2004 which granted approval to change the use of 1,500 s.f. of the property from warehouse use to laboratory and office use in the building located at 85 Maple Street, Stoneham, MA , on land owned by Anthony Saia, Trustee of the Maple Street Realty Trust, 607 Main Street, Stoneham, MA 02180.

Atty. Houghton said the exterior work is all done.  Vice Chairman DePinto said there is no comment on all the department reviews.  

Chairman DePinto opened the hearing to the public.  

Selectman Seibold moved approval of the one-year extension.  Motion was seconded, and a roll call vote was taken.

Angelo’s/237-241 Main St/Site Plan Hearing

Selectman Rotondi read the Notice of Hearing.  Atty. Charles Houghton was present to represent Salvatore and Rosanna Caruso in their petition to construct a one-story addition t the rear and northerly side of the restaurant building, on the property located at 237-241 Main Street, Stoneham, Massachusetts, on land owned by Salvatore and Rosanna Caruso, 16 West Street, Stoneham, MA 02180.

Atty. Houghton said they are proposing two small additions to the restaurant.  One on the northerly side will allow them to increase the seating area and put a bar area in.  The other would increase the kitchen area.  He said the number of seats would remain the same.  He said they lost one parking space but obtained a variance.  Selectman Rotondi read the Project Review comments. Atty. Houghton said they got a couple of variances on the zoning.  

Vice Chairman opened the hearing to the public.

Selectman Seibold moved acceptance of the site plan, with two years for completion, a 7:00 a.m. start for construction, and subject to amending.  Motion was seconded by Selectman Kennedy, and a roll call vote was taken.

Voting was 4-0 in favor.  Motion was unanimously voted (4-0).

Miscellaneous Correspondence

Selectman Kennedy noted the article in the Boston Globe about naming rights. Town Counsel said they potentially have a bid process for people to have that opportunity.  He said he will answer the legal question and then look at who is doing it nationally.

Selectman Rotondi asked about restrictions, and Town Counsel said he can take a look.  Atty. Houghton said there was a warrant article to name the rink.  

Selectman DePinto mentioned the lot owned by Wakefield.  Selectman Kennedy moved that the Town Administrator submit a letter to the Town of Wakefield concerning restrictions on the Wakefield property and also concerns with respect to accessibility and safety.  Motion was seconded by Selectman Seibold and unanimously voted (4-0).  Vice Chairman DePinto added to have the Town Administrator direct the Director of Assessing to look at taxes.  

Town Administrator Reports

Town Administrator Florino said they sent out a survey to 15 communities for information on DPW, Police, and Fire, so they can have that information for the budget process.  

Executive Session

Selectman Seibold moved to go into executive session, pursuant to Chapter 39, section 23B, for purpose of litigation and collective bargaining.  Motion was seconded by Selectman Kennedy, and a roll call vote was taken.
